1. The Mercedes-Benz Talent Cloud The Mercedes-Benz Talent Cloud is a Mercedes-Benz Group AG social career network. The network is made up of the sum of its participants, consisting of non-Mercedes-Benz employees who are interested in working at Mercedes-Benz Group AG, and internal HR colleagues. To this end, every participant has their own user profile, the so-called account. Every user has the opportunity to find out about current Mercedes-Benz topics as well as to take part in selected events and to find out exclusively about job vacancies. The use of the Mercedes-Benz Talent Cloud is voluntary for both parties. There is no entitlement to use it. Agreeing to the terms of use is a condition for using the Mercedes-Benz Talent Cloud.

2. Target group Access to the Mercedes-Benz Talent Cloud is granted to selected employees of the Mercedes-Benz Group AG and incorporated companies as well as external natural persons interested in employment at Mercedes-Benz Group AG.

3. User profile Users may post a photo of themselves on the Mercedes-Benz Talent Cloud. This function of this picture is to simplify and improve communication between the users of the Mercedes-Benz Talent Cloud. The photo posted by the user to the Mercedes-Benz Talent Cloud will only be displayed there and may not be used for other purposes. In addition, it is possible to import the profile picture from social networks such as XING or LinkedIn within the context of further profile details. The user is responsible for ensuring that the necessary user rights exist for the images provided, or other content. If claims are made against Mercedes-Benz as a result of injury of intellectual property rights, Mercedes-Benz reserves the right to sue for damages.

4. “My profile: Personal information and settings Users manage their personal data as well as their individual settings for using the Mercedes-Benz Talent Cloud via the “My profile” menu item. When creating a profile, certain fields are mandatory. If they are not filled out the user cannot be registered. The user is responsible for making sure that their personal data is correct and up to date.

5. “Like” function The user can view current contributions and articles from Mercedes-Benz Group AG via the “Home” menu item. The user can mark contributions they find interesting with a “like”. It is also possible to comment on some content.

6. Rules of conduct In the Mercedes-Benz Talent Cloud we expect a fair and collegial discourse among users. Activity that is not in accordance with the intended use is not permitted and can lead to exclusion from the Mercedes-Benz Talent Cloud. This is particularly true of content that is discriminatory, pornographic, insulting, which glorifies violence, is politically radical or that hurts the religious, ethnic or sexual sensibilities of other users. It is also forbidden to use the cloud for advertising for products or services, i.e. for promotional purposes.

7. Withdrawal and deletion Data in the Mercedes-Benz Talent Cloud are anonymized as soon as they are scheduled for deletion. This means that past activities and attachments of the user are anonymized. Users can prevent the automatic deletion of their data by regularly logging on to the Mercedes-Benz Talent Cloud. At the very latest, the user profile will be anonymized after their consent to the privacy policy has expired.

8. Limitation of liability If Mercedes-Benz Group AG has to bear the damages on the basis of legal or contractual provisions, it bears limited liability as follows: Liability exists only in cases of the breach of contractual duties and is limited to the damages that are typical, contractual and foreseeable at the conclusion of the contract. Liability for lost use and lost profit is excluded. Furthermore, Mercedes-Benz Group AG assumes no responsibility for the availability of the Mercedes-Benz Talent Cloud as well as for the correctness of information provided by a user contained therein. These aforementioned limitations and exclusions of liability do not apply in the event of the loss of life, physical injury and damage to health as well as to other damages based on a deliberate or grossly negligent breach of duty by Mercedes-Benz Group AG or one of its legal representatives or vicarious agents. The foregoing limitations and exclusions of liability equally do not apply to compulsory statutory strict liability (e.g. pursuant to product liability law) or liability resulting from a guarantee irrespective of fault.
